The success of our lawyers before the National Board of Appeal

We are pleased to inform about the success achieved by trainee legal adviser Magdalena Raniszewska in cooperation with expert Katarzyna Wińska-Rużewicz in appeal proceedings conducted before the National Board of Appeal on 28th of January 2014.

In the course of the proceedings of public procurement conducted in an open tender named Reconstruction of bridge No. 3, together with a spur in the side entrance as a part of the expansion of the marina in Krynica Maritime, on behalf of the Law Firm’s client, we appealed against contract notice and the specification of essential terms of the contract concerning the conditions for participation in the proceedings, alleging the Contractor the breach of the Public Procurement Law, among others by:

–          conducting the proceedings of public procurement in a manner that doesn’t guarantee fair competition and equal treatment of operators,

–          describing the assessment of the fulfillment of the condition of knowledge and experience in a manner disproportionate to the subject of the contract,

–          describing the assessment of the fulfillment of the condition of knowledge and experience in a manner not associated with the contract.

After conducting the proceedings and hearing the parties, the National Board of Appeal agreed with the appellant and therefore upheld the appeal in its entirety, overriding conducted by the Municipality of Krynica tender procedure, encumbering the Contracting Authority with the proceedings’ costs.
